1. General
1.1 BT Built specialises in the design and construction of custom decks and pergolas for residential and commercial customers. All efforts are made to ensure the accuracy of information displayed on our website; however, this electronic publication does not constitute a binding offer of services.
1.2 All measurements and specifications provided are approximate and should be confirmed during the consultation process.
1.3 BT Built does not offer pre-made products or assembly services. All projects are built on-site according to client specifications.
1.4 The reproduction of colours and design visuals is as accurate as possible; however, variations may occur due to the nature of digital displays and material availability.
1.5 All risk related to construction materials and completed structures passes to the customer upon project completion and handover. Ownership of the constructed pergola or deck shall not pass to the customer until full payment has been received.
1.6 BT Built shall not be liable for any indirect losses the customer may experience, including loss of profit, income, or anticipated savings, as a result of our failure to comply with these terms or our negligence. Liability for any death or personal injury caused by our negligence is not restricted by these terms.
1.7 These terms represent the entire agreement between BT Built and the customer, superseding all prior arrangements and representations, whether verbal or written.
1.8 We may amend these terms at our discretion without prior notice to the customer. Any amendments will be posted on our website and will replace previously published terms.
1.9 No delay or failure by BT Built in exercising any of our rights under these terms shall operate as a waiver of those rights.
1.10 If any provision of these terms is deemed unenforceable by a court, it shall be modified to reflect the intent as closely as possible, or severed if necessary, without affecting the validity of the remaining terms.
1.11 The customer may not assign or transfer any rights or obligations under these terms without our prior written consent.
1.12 These terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
2. Force Majeure
2.1 BT Built shall not be liable for any delay or failure to fulfil our obligations if such delay or failure arises from unforeseeable circumstances beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, or supply chain disruptions.
3. Pricing and Payment
3.1 All quoted prices are subject to change until a formal agreement is signed. Quotes are valid for 30 days unless otherwise specified.
3.2 Payment terms, including deposits, progress payments, and final payment, will be outlined in the project agreement. Full payment must be received before ownership of the completed project passes to the customer.
3.3 BT Built reserves the right to adjust prices if unforeseen costs arise during the project, provided these changes are communicated to and agreed upon by the customer.
3.4 All prices include GST where applicable.
4. Project Delivery and Completion
4.1 BT Built will make every effort to complete projects within the agreed timeline. However, delays may occur due to weather, material availability, or other external factors.
4.2 Customers must ensure the worksite is accessible and ready for construction as agreed upon. Additional costs may apply if delays occur due to site inaccessibility or preparation issues.
4.3 All completed work will be reviewed with the customer upon completion to ensure satisfaction and address any concerns.
5. Confidentiality and Privacy
7.1 BT Built respects customer privacy and complies with Australian privacy laws. Customer information will not be shared with third parties without consent, except as required by law.
6. Consumer Rights
8.1 These terms do not affect the customer’s statutory rights under Australian consumer law.
